GENERAL REQUIREMENTS

  • Residents are required to park in their garage per CC&Rs Section 7.8.3.

  • All vehicles required to have current state registration tags.

  • All two or four wheeled modes of transportation must adhere to all posted signage within Laurel & Magnolia HOA.

  • Changes to these rules may happen at the Board’s discretion.

LAUREL & MAGNOLIA VEHICLE REGISTRATION

  • All resident vehicles must be registered annually at:  https://laurelmagnolia.parkingattendant.com/laurelmagnolia/services

  • Residents who fail to register their vehicles will not be eligible to register for overnight guest parking.

  • In the event an owner sells or transfers the unit, the owner must provide the buyer a copy of the parking rules and inform the new owner to contact the property manager to immediately register their vehicles.

  • In the event an owner rents the unit, the owner must provide the renter with a copy of the parking rules and immediately register the renter’s vehicles and remove any previous tenants’ vehicles.

RESIDENT PERMITS FOR NON-GARAGE COMMUNITY PARKING

  • Laurel & Magnolia HOA may issue permits allowing residents to park outside their garage within the community if requirements are met.

  • If number of requests meeting requirements exceed the number of spaces available for residents a lottery system may be implemented.

    • Residents with permits for non-garage community parking may park in any available lined space.

  • Only residents with oversize vehicles or residents with a third vehicle and a third licensed driver may apply for a permit.

  • The fee for each permit is $240 annually, payable up front to Laurel and Magnolia HOA after approval.

    • The fee for a permit may change periodically at the Board’s discretion.

  • Permits may be revoked if owners are delinquent paying dues, assessments, a fine or if the owner is in violation of any of the HOA governing documents.

  • Permits will be determined after garage inspections. 

  • Oversize vehicle measurements must be provided along with a garage photo.

  • Any items that prohibit a vehicle from otherwise fitting in the garage will not be considered.

  • Resident parking permits are non-transferable. Only the vehicle approved for the permit will be allowed to park outside the garage.

  • In the event a permit holder sells or rents their home the current permit will not be valid.  No refund will be given for the balance of the cost of the permit.


GUEST PARKING

  • The City of San Marcos requires one guest parking space for every three homes in a condominium development.

  • Registration for guests is only required for overnight parking.

  • Guests may park in any lined space.

    • Every owner in good standing may register a guest to park for seven days per month.

    • To be eligible for guest parking, owner vehicles must be registered with Laurel & Magnolia HOA.

    • Owners who are delinquent will not be eligible for guest parking until the delinquency is resolved.

    • A single guest may park for seven consecutive nights or any combination of nights totaling no more than seven per month.

    • Residents may only register one guest at a time even if the combined stay doesn’t exceed seven days.

    • Parking spaces are not guaranteed regardless of registration. Spaces are on a first come, first served basis.

    • It is the residents’ responsibility to register their guests using the resident-specific code provided in the mailer.

      • Any fines resulting from failure to register guests will be the owner’s responsibility to pay. Non-payment will result in delinquency.

ENFORCEMENT AND TOWING POLICY

  • Guest and resident parking rules will be enforced nightly.

    • Violations include, but are not limited to, failure to register a guest, failure to register a resident vehicle, parking in a fire lane, parking on a garage apron, or parking in a manner that blocks traffic.

  • First offense will result in a warning.

  • Second offense will result in a fine of $120.

    • Fines are the owner’s responsibility to pay. Non-payment will result in delinquency.

    • The cost of a fine may change periodically at the Board’s discretion.

  • Third offense will result in towing.

    • Vehicles parked in violation of the Association’s CC&Rs, these Rules or in violation of local ordinances may be towed at the vehicle owner’s expense immediately without warning (California Vehicle Code Section 22658).  This includes parking in a fire lane, parking within 15 ft of a fire hydrant, on a garage apron, in a manner that blocks traffic, creates a safety hazard or disregards No Parking signs or handicap spots without visible handicap tags.

  • It is the Homeowner’s responsibility to educate any tenants, renters, or other persons living at their residence as to the rules and enforcement laid out in this policy. Responsibility will not fall on the Association or Property Management for making sure tenants, renters, guests or the like are aware of the parking policy.

  • The Board may adopt a different method of monitoring and enforcement at any time.

TEMPORARY EXEMPTIONS

  • Residents may request temporary extended parking on an as needed basis in advance.  This would be for something such as a remodel and there must be evidence to support the request provided to the property manager including photos of the garage along with the description of the circumstance. The length of time granted might not equal the duration of the request.  Please allow 5 business days for review.

  • Owners may register college students visiting during school break for temporary extended parking in the portal.  All requests must be accompanied by an email to the property manager with the vehicle registration, school ID and school calendar showing the dates of the break. Alternatively, owner may apply for a resident permit if available.

  • Special exceptions may be made on a case-by-case basis for active-duty military to be compliant with the Service Members Civil Relief Act.

FIRE LANES

  • Laurel & Magnolia fire lanes include areas marked with a red curb, garage aprons and unpainted curbs with a Fire Lane sign within 50 ft.

    • California Vehicle Code Section 22514 states that 15-foot clearance is required on either side of a fire hydrant.

    • There are no exceptions for unpainted curbs. Even if the curb is not painted red, parking within 15 feet of a fire hydrant is illegal and could result in immediate towing at the owner’s expense.

AUTHORIZED VEHICLES

  • Only authorized vehicles are eligible to obtain resident parking permits. According to Article 7, Section 7.8.1 of the CC&Rs, the following vehicles are “authorized vehicles”:

    • Standard passenger vehicles including automobiles, passenger vans designed to accommodate ten or fewer people, motorcycles and pickup trucks having a manufacturer’s rating or payload of one ton or less and vehicles which are the principal source of transportation for an owner.

  • No authorized vehicles may be parked in a manner that restricts the passage of pedestrians or vehicles over streets, driveways or sidewalks in the community or which extends beyond the limits/boundaries of the parking space.

  • Prohibited vehicles may not be parked, stored or kept within the property or any private street within the community except for brief periods for loading, unloading and making deliveries. According to Article 7, Section 7.8.2 of the CC&Rs, the following are “prohibited vehicles”:

    • Recreational vehicles (e.g., motorhomes, travel trailers, camper vans, boats, etc.).

    • Commercial-type vehicles (e.g., stake bed trucks, tank trucks, dump trucks, step vans, concrete trucks and limousines etc.).

    • Buses or vans designed to accommodate more than ten (10) people.

    • Vehicles having more than two (2) axles.

    • Trailers

    • Inoperable vehicles or parts of vehicles.

    • Aircraft

    • Boats

    • Any vehicle or vehicular equipment deemed a nuisance by the Board.

    • Any other vehicle not classified as an Authorized Vehicle.
